Assists the Product Safety and Claims group with the primary activity of managing product liability, premises liability, and professional liability claims brought against Emerson business units. This position also provides paralegal and administrative support concerning Emerson product safety matters including Emerson's reporting responsibilities to the Consumer Product Safety Commission (“CPSC”) and to other government agencies, product safety recall and safety notification tracking, and due diligence support for product safety issues for merger, acquisition, and divestiture activities for the corporation.
ManagingClaims
Maintaintracking system database for claims and theirrelated records.
Foreach claim matter, retain and coordinate the investigation team including EmersonBU personnel, outside counsel, technical experts, and other investigators.
Gatherfacts from involved parties such as claimants, business unit technicalpersonnel, outside experts, regional counsel, third-parties, and in-house legalstaff.
Researchonline reports of incidents that resulted in claims.
Incoordination with Product Safety Officer, resolve or close claims.
Prepareregular or ad-hoc reports and provide information to relevant parties.
Assistin pre-trial discovery and information requests for claims that mature intolitigation.
Collaborationwith Business Units and outside resources
Communicationand collaboration regarding claims with the BU's including scheduling and investigationplanning, document collection, and regular status updates on the claim process.
Communicationwith BU's regarding safe product design, manufacturing, product uses, training,and warnings creation for Emerson products.
Communicatewith and coordinate experts and outside counsel whom are retained by Emerson asteam members for the various claim matters.
Draftand coordinate issuance of litigation hold notices for the business units.Coordinate the lifting of notices if claim is resolved prior to litigation.
Supportfor Product Safety recalls, retrofit, and safety notifications
Assistin Product Safety recall or retrofit activities.
Maintaintracking system regarding commercial industrial safety notices Emerson-wide.
Assistwith reporting responsibilities
Collect,analyze and compile information relevant for reporting to the CSPC and otherapplicable government agencies.
Collaboratewith relevant parties (such as outside counsel, business unit personnel and theCorporate Product Safety Officer) on Freedom of Information Act (FOIA) requestsfrom the CPSC or other requests.
ProvideDue Diligence support on product safety issues for mergers, acquisitions anddivestitures.
Review M&A correspondence to identify ProductSafety-related issues.
Insure that claims and product safety issues are tracked andreviewed by appropriate Emerson managers during the M&A process.
Drivepositive Change
Incollaboration with the Product Safety and Claims group and the wider Legal team,identify and advance improvement opportunities in the product safety and claimsadministration, reporting and management process with specific focus onleveraging of technology.
Experience:
Four years or more experienceinvolving claims or litigation management/ administration or in the insuranceindustry.
Desired Certificates,Licenses, Registrations:
